Judge Tony Graf ruled Tuesday that Tyler Robinson will stand trial in the fatal shooting of Charlie Kirk, finding prosecutors presented enough evidence at this stage for the case to move forward.
“Viewed in the light most favorable to the prosecution, this evidence is sufficient at this stage to support a reasonable belief that the defendant is the individual who shot and killed Charlie Kirk,” Graf said from the bench. “Accordingly, the state has demonstrated probable cause as to the identity and homicide elements of count one.”
The ruling follows a day of arguments during Robinson’s preliminary hearing in 4th District Court in Provo. The judge is also addressing whether prosecutors can continue seeking the death penalty, a decision that hinges on whether the state established the required aggravating circumstance.
